1. Agreement to Terms

By accessing or using the services provided by ZCT Consulting ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access our services.

2. Description of Services

ZCT Consulting provides managed data platform services, including but not limited to:

• Data integration and pipeline management
• Analytics and dashboard creation
• Data consulting and strategy services
• Custom data solutions and AI tool development
• Data infrastructure management and support

3. User Accounts and Registration

To access certain features of our services, you may be required to register for an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain and update your account information to keep it accurate
• Maintain the security of your account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

4. Payment Terms

4.1 Subscription Fees

Subscription fees are billed in advance on a monthly or annual basis, as specified in your service plan. All fees are non-refundable except as required by law or as explicitly stated in these Terms.

4.2 Payment Methods

We accept payment through credit cards, debit cards, and other payment methods as specified during checkout. You authorize us to charge your payment method for all fees associated with your account.

4.3 Price Changes

We reserve the right to modify our pricing at any time. Price changes will be communicated to you in advance and will apply to subsequent billing cycles. Continued use of our services after a price change constitutes acceptance of the new pricing.

5. Refund Policy

Subscription fees are generally non-refundable. However, we may provide refunds or credits at our sole discretion in exceptional circumstances. Refund requests must be submitted within 14 days of the initial purchase. Consulting hours packages are non-refundable once services have been rendered.

6. Cancellation and Termination

6.1 Cancellation by You

You may cancel your subscription at any time through your account settings or by contacting us. Cancellation will take effect at the end of your current billing period. You will continue to have access to the services until the end of the paid period.

6.2 Termination by Us

We reserve the right to suspend or terminate your account and access to our services immediately, without prior notice, if you violate these Terms, engage in fraudulent activity, or for any other reason we deem necessary to protect our services or other users.

7. User Obligations and Acceptable Use

You agree not to:

• Use our services for any illegal or unauthorized purpose
• Violate any laws, regulations, or third-party rights
• Interfere with or disrupt the integrity or performance of our services
• Attempt to gain unauthorized access to our services or systems
• Use our services to transmit viruses, malware, or other harmful code
• Reverse engineer, decompile, or disassemble any part of our services
• Resell, sublicense, or redistribute our services without authorization

8. Intellectual Property Rights

All content, features, and functionality of our services, including but not limited to text, graphics, logos, and software, are owned by ZCT Consulting or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of your data. By using our services, you grant us a limited license to use, process, and store your data solely for the purpose of providing our services to you.

9. Data and Privacy

Your use of our services is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using our services, you consent to the collection and use of your information as described in our Privacy Policy.

10. Service Availability and Modifications

We strive to provide reliable services but do not guarantee uninterrupted or error-free operation. We reserve the right to modify, suspend, or discontinue any part of our services at any time, with or without notice. We are not liable for any loss or damage resulting from such modifications or interruptions.

11. Limitation of Liability

To the maximum extent permitted by law:

• Our services are provided "as is" and "as available" without warranties of any kind
• We disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose
• We shall not be liable for any indirect, incidental, special, consequential, or punitive damages
• Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim

12. Indemnification

You agree to indemnify, defend, and hold harmless ZCT Consulting and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of our services, violation of these Terms, or infringement of any rights of another party.

13. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of The Netherlands, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of our services shall be resolved through good faith negotiations. If a resolution cannot be reached, disputes shall be submitted to the exclusive jurisdiction of the courts of The Netherlands.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of our services after such modifications constitutes acceptance of the updated Terms.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
